To clearly explain my thinking and reading about the current topic of what some say is “Unlawful imprisonment of assumed terrorists” in the Guantanamo Prison. We need to zoom in on the broad topic of Guantanamo and focus on a very recent case with the name of Al Qahtani V Obama. This case involves Al Qahtani who was hold up in Syria and later detained by American officials, He was detained based on charges of conspiracy and terrorism. The problem and the main point of the case is why does America have the right to detain individuals or groups when they are not technically on U.S soil. That description that I made of the case was very unbiased to write, however I have a very conservative mindset when it comes to terrorism in the world. I believe that if a person that does get arrested and detained overseas should be able to be prosecuted in the justice system of a fair court that isn't corrupt by terrorists and organisations in the middle east. As we can all admit as Americans the courts system isn't always perfect with black and white picture we can at least say that we have a very fair system of interpreting consequences. You could compare this type of case to something like post pearl harbor when Roosevelt detained vast numbers of Japanese-Americans, some believed the government had no right to do that, however we had just been threatened on a large scale that affected national security. Some other viewpoints of the judges of the supreme court say that “these men aren't all bad but the common good for the people leans over the potential setting free off 900+ terrorist.” the other side of this case believes in the human rights side of things and believe it is even against habeas corpus rules that have been in place for a little less than a century. The 8th amendment clearly states that unlawful imprisonment is unconstitutional so it will be interesting to see how the judges interpret the situation of Al Qahtani and ultimately of the Guantanamo Bay Prison. In my opinion the thing that americans should be the most worried about the rights that we have in place for certain people. Society should be discrimination free, however discrimination isn't always bad, in fact we need discrimination when we separate mass murdering terrorists, that are violent extremists. Do not misunderstand me when I say the word terrorist, the thing is that it needs to be undoubtedly proven that they are indeed terrorists before people can give them that label. These rights do matter to me specifically because if I ever were locked up in a correctional facility or in a international bind where I would get detained in spain, I would deserve not to be treated cruelly or have my right abused in any further way. I think personally violent and even potentially deadly people should be treated fairly in the correction setting but for the people of the United States it is for the common good that these criminals are exterminated for existence until they're proven innocent based on U.S standards.
